"My goal is to provide a safe, non-confrontational setting, where couples can resolve their differences in a way which is economical and emotionally cost-effective." --- Attorney Genell Greenberg, MSW

Genell Greenberg knows that choosing a mediator can be a difficult decision. This is especially true if you and your spouse are at odds, and unable to communicate about many things, not the least of which is selecting a mediator. You should seek a professional with whom you feel comfortable, and who understands both the legal and emotional issues involved in the divorce process. As a social worker, family law attorney and mediator, Genell has the experience and qualifications to guide you to a fair agreement.

Her knowledge of family law, and training and experience as a social worker, sets her apart from most other mediators. Her dual background allows her knowledgeably to mediate both financial and parenting issues -- while remaining sensitive to her clients' emotional concerns.

"I understand how difficult divorce can be, even under the best of circumstances. It is a legal, financial and psychological process. I made the decision to specialize in family law mediation after years of representing clients in the adversarial system and observing the devastation of traditional litigation for couples, families and children."

Mediation offers many advantages. It saves time and money, and encourages cooperation so couples may separate with a minimum of interpersonal hostility. Mediation provides a safe place to address the legal issues, while acknowledging the emotional chaos of divorce. As they work towards settlement, couples are able to plan for their future. This is especially important where the parties will have continued contact, for example, where children are involved. When children see their parents be respectful to each other, they will model this behavior in their future dealings.

Genell has mediated divorces with clients of all ages, in marriages both brief and long, and involving a variety of complex assets and debts. "I tell my clients their legal rights and obligations so that they can make informed decisions and be realistic in their expectations. Despite intense, often painful feelings, they have been able to work out co-parenting schedules and resolve a broad range of concerns relating to the needs of children. With my experience and background, I can help you mediate your divorce in a civilized manner which offers the least stress and the maximum savings."

Genell Greenberg's Recommendations For Selecting a Mediator.

Mediators are not formally licensed or accredited, so you must do your homework to find a qualified professional. Choose an individual who is competent and with whom you both feel comfortable. In selecting a mediator, consider the following:

  • Divorce Mediators typically are attorneys or mental health professionals who have one or more advanced degrees. Some mediators practice in lawyer/counselor teams, while others mediate individually. Non-attorney mediators should understand the fundamentals of family law regarding custody, support, property and taxation. Attorneys should understand the psychological issues in separation, divorce and family dynamics, and the special needs of children of divorce.
  • Choose a mediator who has the ability to draft legally enforceable divorce documents that will be correctly processed with the Court.
  • Inquire about the mediator's background and experience. Seek an Advanced Practitioner Member of the Association for Conflict Resolution (www.acrnet.org), or an individual with comparable experience. Practitioner Members must have completed at least 250 hours of face-to-face family mediation and at least 25 family mediation cases.
  • Mediation fees vary, depending upon the professional's credentials and experience and whether they practice individually or on a team. Some mediators request an initial retainer and most expect payment at each mediation session. Clarify the fee arrangements at the beginning of the mediation process, and decide how you will share the costs.
