Mediation
offers many advantages. It saves time and money, and encourages cooperation
so couples may separate with a minimum of interpersonal hostility.
Mediation provides a safe place to address the legal issues, while
acknowledging the emotional chaos of divorce. As they work towards
settlement, couples are able to plan for their future. This is especially
important where the parties will have continued contact, for example,
where children are involved. When children see their parents be respectful
to each other, they will model this behavior in their future dealings.

For Selecting a Mediator. |
Mediators
are not formally licensed or accredited, so you must do your homework
to find a qualified professional. Choose an individual who is competent
and with whom you both feel comfortable. In selecting a mediator,
consider the following:

Divorce Mediators typically are attorneys or mental health professionals
who have one or more advanced degrees. Some mediators practice
in lawyer/counselor teams, while others mediate individually.
Non-attorney mediators should understand the fundamentals of family
law regarding custody, support, property and taxation. Attorneys
should understand the psychological issues in separation, divorce
and family dynamics, and the special needs of children of divorce.

Choose a mediator who has the ability to draft legally enforceable
divorce documents that will be correctly processed with the Court.

Inquire about the mediator's background and experience. Seek an
Advanced Practitioner Member of the Association for Conflict Resolution
(www.acrnet.org), or an individual
with comparable experience. Practitioner Members must have completed
at least 250 hours of face-to-face family mediation and at least
25 family mediation cases.

Mediation fees vary, depending upon the professional's credentials
and experience and whether they practice individually or on a
team. Some mediators request an initial retainer and most expect
payment at each mediation session. Clarify the fee arrangements
at the beginning of the mediation process, and decide how you
will share the costs.
